Lemon Law – Mechanics Flat Rate Pay System

By Donald Ladew There is a relationship between the auto repair technician Flat Rate pay system and the incidence of unrepaired Lemon Vehicles. It is more direct than one might think. What is Flat Rate Pay System? Its old-fashioned piecework plain and simple. Imagine picking peaches. Instead of an hourly wage, you get paid a penny a peach. The auto manufacturer establishes fixed times for every conceivable repair. This includes everything from a bulb replacement to installing a new engine. Most dealerships charge between $60 and $70 dollars an hour for warranty repairs. Its in the dealerships contract with the manufacturer that they may only charge for the repair hours provided by the manufacturer. Here are some of the links in this chain of cause and effect: – The modern automobile is computer controlled and complex. – Vehicle computers fail and these software/computer hardware failures appear to be other non-computer components in the vehicle. – Modern diagnostic tools dont isolate faults; they suggest possibilities, areas of vehicle systems that might be at fault. – The technician is rewarded for how fast he or she works, not how well. – The dealership makes good money for warranty and non-warranty repairs. – Quality and customer satisfaction are advertising slogans, not a way of life in the work place. – Quite often poorly trained mechanics cause more trouble than existed in the vehicle before attempted repairs. – The slow technician, whether excellent or not, will barely make a living and certainly receive hard talk from his supervisors. Are all vehicles declared lemons at buyback unrepairable? Probably not. Given these conditions, the chances a faulty vehicle will meet lemon vehicle legal definitions, i.e., four repair attempts during the warranty period, are significantly increased. The Dealership Situation Heres an example of what dealerships consider a bad, bad thing. 1. A car that is still under warranty has a defective transmission. The manufacturer assigns transmission replacement a time to repair of 4.5 hours. At $65/hour for warranty repairs, the dealership gets paid $292.50 by the manufacturer for this warranty repair. (Remember, the manufacturer pays for warranty repairs.) 2. If it takes the dealerships technician 6.75 hours to complete the repair. The dealership must eat 2.25 hours of technician repair time. 3. If the technician takes 3.9 hours to make the repair, the dealer will still charge the manufacturer 4.5 hours, and even though the technician only spent 3.9 actual hours on the job, he will be paid for 4.5 hours. 4. In the first case the service manager at the dealership complains to the technician, “sorry, Joe, the manufacturer reduced repair times again. You know those %^$%^$# arent part of the real world, they dont know how long it takes to make orange juice!” Hes also going to strongly “encourage” the technician to make the repair in less time than that assigned by the manufacturer. It is an unjust system with no redeeming value for the honest technician or the dealership. Whos the big loser? You guessed it, the customer. All the players in this game have very different viewpoints. Lets review them. Manufacturer The manufacturer screams about being ripped off by the dealership for inflating warranty repair hours, and that the dealership is doing unnecessary warranty repairs. Both accusations are probably correct, but not necessarily for the reasons suggested by the manufacturer. Dealership The dealership moans and groans about how unfairly the manufacturer establishes and even reduces the hours allowed for each warranty repair. They also claim they have no say in how the hours were established in the first place. Both of these accusations are entirely correct. Manufacturers also have a policy of not paying for repeated warranty repairs to fix the same malfunction. How does the dealership respond to this? Its not good. If the dealership sees a repeat problem, they must somehow make it appear to be different that the original malfunction. Charitably, this can lead to untruthfully describing a problem on the repair order. Remember, four repair attempts for the same problem is one of the criteria that defines what is and is not a lemon. Wheres the incentive to do honest, quality work? Mechanic The immediate effect of manufacturers cutting the flat rate (piece work) times is a reduction in the mechanics paycheck. In order to maintain the same pay rate the mechanic must work that much faster. Faster is not consistent with quality repairs, quite the contrary. At the same time the manufacturer is demanding higher quality repairs. Its a Catch 22 wherein everyone loses. Add to this inadequate training at best and one has a recipe for the Lemon connection. Consumer The consumer has no idea about the complex business relationships that exist between manufacturers and dealers, nor do they have any interest. Why should they? The consumers needs are quite simple. Sell me a car for a decent price that does what the advertisements say it will. If it needs a repair, have someone competent and well trained do the work and for Petes sake get it right the first time. Final Thoughts Theres something seriously wrong with the system. Its a system that rewards all the wrong things. Like many such systems in other parts of American business, this system rewards quantity, not quality. There seems to be an inherent inability among business managers to draw a connection between quality and business success. The manufacturer sets up quality rewards systems, such as Fords Blue Oval, then turn around and cut the work/task hours arbitrarily, probably to allow a senior executive to look good by improving the bottom line of a quarterly report. The result is an immediate drop in quality work at the dealership. There are so many contentious viewpoints, and so little willingness among the players to correct the situation. I wish I could offer some hope to consumers that efforts are being made to resolve this situation, but I havent seen any such evidence. Perhaps this essay will at least bring some sense to a nonsensical mess. See if your employer offers any scholarships. Get a job at a fast food place and apply for their corporate dollars. The business will have nice press, and you will have a nice check. The authors premise is that this type of growth will not occur unless you are creating delighted customers and measuring your progress in doing just that. What is the measurement? Companies need only ask one questionthe Ultimate Questionin a regular, systematic and timely fashion. These businesses want customers who are so pleased with how they were treated that they willingly come back for more and bring their friends and colleagues with them. Bad Profits Mr. Reichheld begins our journey to the Ultimate Question by defining bad profitsthese are profits earned at the expense of customer relationships. At times, customers must conclude that businesspeople lie awake nights thinking up new ways to hustle them. (Just think of your celluar phone service, for example.) Bad profits are destructive to long-term, profitable growth because they create detractors. Detractors stop buying from your company, switch to your competition (if they can), and tell others about their bad experiences with your company. They get even. Remember, the old adage, an unhappy customer tells 10 friends? With modern telecommunication technology, this can just as easily be 10,000 friends. There is certainly a biblical perspective on how we are to treat our customers. One verse that comes to mind is Philippians 2:3-4, Do nothing out of selfish ambition or vain conceit. Rather, in humility value others above yourselves, not looking to your own interests but each of you to the interests of others. And so it is sad to read the following examples: Retail banks now depend on nuisance fees for as much as 1/3 of reported earnings. Mobile-phone companies realize that if they put customers in the calling plan that would be best for the customer, the phone company would cut their profits by 40%. The examples could go on and on. Customers resent bad profits. Good Profits Good profits are earned with customers enthusiastic cooperation. Satisfied customers become part of the companys marketing department. They become promoters. Our goal should be to create promoters, not detractors. How do we get started? Revisiting your companys core values would be a great place to begin. For example, I wonder if eBays phenomenal growth can be attributed to their Community Values: eBay is a community that encourages open and honest communication among all its members. Our community is guided by these fundamental values: We believe everyone has something to contribute. We believe that an honest, open environment can bring out the best in people. We recognize and respect everyone as a unique individual. We encourage you to treat others the way you want to be treated. eBay has found ways to operationalize these values into their daily priorities and decisions. And more than 70% of eBay customers are promoters. The company encourages its members to point out areas in which they believe eBay isnt living up to its principles, and to identify new opportunities to better serve members. These loyal members are the key to profitable growth. Loyalty But how can companies know how many of their customers truly love their company and how many hate it? The authors research shows that a 5% increase in customer retention can yield anywhere from a 25% to a 100% improvement in profits. The research also showed that companies with the highest customer loyalty typically grew revenues at more than twice the rate of their competitors. And this customer loyalty stems from how each and every customer is treated by our employees. So why cant we just make our employees care more about customer relationships? Metrics Financial results determine how managers are rewarded. But our accounting procedures cant distinguish between good and bad profits. We measure success through the lens of financial accounting. Managers tend to focus on profits regardless of whether those profits represent the rewards from building relationships or the spoils from abusing them. Promoters and detractors dont show up on anyones income statement or balance sheet. A Practical Metric for Relationship Loyalty The Ultimate Question, if asked systematically and linked to employee rewards, can help you manage for customer loyalty and the growth it produces. So what is the Ultimate Question: How likely is it that you would recommend this company to a friend or colleague? (Note: for a business-to-business setting, a question such as, How likely is it that you will continue to purchase products or services from us? may be better.) The author created a Net Promoter Score (NPS) which is simply to take the percentage of customers who are promoters (those who answer a 9 or 10 on a 0-to-10 scale) and subtract the percentage who are detractors (those who answer a 0-6 on a 0-10 scale). Using the Subconscious for Pain Relief – What’s In It For You?

By Ben Plumb If you’re in chronic pain, you probably want 7 things. If you can learn to use visualization statements to program your subconscious, you may be able to attain most or even all of them. The 7 things you probably want are to directly relieve your pain by any safe means possible, to indirectly relieve it using the mind-body connection, to avoid dependence on pain medications, to avoid dependence on doctors, to avoid helplessness, to be able to function despite your pain, and to avoid more ongoing costs related to your pain. Visualization statements provide a useful tool for attaining many of these goals. These statements represent the specific language that your subconscious wants you to read back to it to help ease your pain. Theyre simple and are targeted directly at the main factors that could bring you relief. You can obtain these statements by learning how to communicate directly with your own subconscious mind. The process is straightforward and can be done at home by working with a facilitator over the telephone. You you need no special skills and no previous experience in working with the subconscious. Goal 1: Directly Relieve Pain You’re probably most interested in anyting that may directly and safely relieve your pain. Through visualizations you can attempt direct relief yourself, using the subconscious to try to influence brain chemistry in ways that may reduce the pain signal. You can also use visualizations to try to minimize body system triggers of pain such as the musculoskeletal, immune, and endocrine systems. And you can further use visualizations to try limit lifestyle triggers of pain such as emotions, food, and lack of sleep. Goal 2: Indirectly Relieve Pain You might want to be able to use aspects of the mind-body connection to lessen the pain. Visualizations may allow you to use the subconscious to try to access positive feelings, provide distractions, obtain relaxation, and generate acceptance, all of which have been shown to help ease pain. Goal 3: Avoid Dependence on Pain Meds You probably want to reduce your dependence on pain medications that make you groggy, make you sick, or don’t work. To this end you can use visualizations to influence the subconscious try to limit the four main chemical amplifiers of pain–glutamate, substance P, norepinephrine, and acetylcholine. You can also use visualizations to attempt to strengthen the four main inhibitors of pain–endorphins,GABA, serotonin, and dopamine. Goal 4: Avoid Dependence on Doctors If any of your doctors are providing callous treatment, invasive procedures, or under-medication, you probably want to reduce your dependence on them. Through visualization statements you can try to use the subconscious to address your pain yourself. Specific visualizations can be aimed at back pain and pain in the neck area and other extremities, fibromyalgia, arthritis, and neuropathic pain (nerve pain), and may possibly produce relief. Goal 5: Avoid Helplessness If you’re feeling helpless you probably want the ability to take back psychological control of your life despite your pain. You can use the subconscious to try to talk down the pain, naturally alter brain chemistry, increase self-esteem, and build expertise about your pain, all of which helps to build self-confidence. Goal 6: Be Able to Function You probably want to be able to function despite your pain. A major factor in allowing you to do this is to consistently get good sleep. You can use visualization statements to try to program the subconscious to improve your sleep by allowing you to find a comfortable sleeping position, stay asleep despite the pain, get back to sleep quickly, and handle the poor sleep of fibromyalgia. Goal 7: Avoid Ongoing Costs You no doubt want to avoid taking on yet another series of ongoing costs related to your pain. Unlike drugs or surgery, use of the subconscious is a learned skill obtained via a one-time investment, rather than as a consumed service that must be repeatedly paid for. Engaging the Subconscious The subconscious is quite powerful. When programmed through the very visualizations that it suggests, it may be able to turn episodes of uncontrolled pain into events over which you have a degree of control. Emotional Eating – Why We Turn to Food

By Carol Solomon Last week, I saw a movie called “Scoop” with Woody Allen. While there was a lot of great dialogue, my favorite line went something like this: “I never put on weight. My anxiety acts as an aerobic exercise” :-) If only that were the case, many women would be in much better shape than they are with emotional eating. Unfortunately, it often works just the opposite. We turn to food when life gets tough, and we have feelings that we don’t know what else to do with. It’s not surprising that we turn to food when we feel stressed, depressed, anxious or just about anything. It’s the easy thing to reach for. After all, life is hard . . . food is easy. A UCLA study of 17,000 dieters, most of them women, found that virtually ALL of them relapsed because of emotional eating. Women are much more susceptible to emotional eating than men, primarily because we are taught to stuff our feelings. Even when we figure out that it’s ok to express feelings, we simply don’t know how. Logically, we know it’s ok, but emotionally, it doesn’t feel ok, and we fear the consequences of doing so. We also don’t know how to ask for help . . . so we turn to food for comfort and self-soothing. Because it’s easy. We do everything for everybody else — FOOD is what we can give ourselves. (After all, we DESERVE it, as the logic goes). And since we are used to using food in response to feelings, it becomes associated with positive events and feelings too. A common refrain: “I eat for every feeling I’ve ever had.” We don’t want anyone telling us we can’t have it. It’s the one thing we can absolutely control, even though it can feel out of control when we overdo it. It often just seems too HARD to manage feelings any other way. And it DOES take more time and attention. It’s not that it’s hard, really . . . it’s like anything else . . . it’s just a matter of learning the right things. Once you learn it . . . then it’s easy. But I won’t lie to you . . . sorting things out emotionally, and being willing to feel your feelings DOES take a bit more effort than reaching for a carton of ice cream when the going gets rough. You CAN get a quick soothing effect with emotional eating. That is why this phenomenon is so resistant to change. The problem is, of course, it doesn’t last. In fact, it only makes things worse in the long run. Now you have the stress you were acting on, AND the feelings about the emotional eating (and the feelings about yourself) to contend with. So, it’s your decision . . . resolve to learn what you need to learn to manage emotions. Give yourself some time to do this (6 months to a year is a good time frame). At this point, while most would consider the placement complete from both the candidate and employers side, I would put forth that you are not quite at the finish line just yet. Lurking the in darkness, is the dreaded fall-off and counter offer. The fall off occurs when the candidate has accepted the position and then decides to stay at their current employer or take another competitive position without warning or notice. The counter offer occurs when the candidate goes into to resign/give notice, and they are financially induced to stay with their current employer. Either way, the client employer loses in the end as a once promising addition to your team makes the wrong decision. While the headhunter has a vested stake in the placement process and will be certain to cover both these possibilities several times during the recruitment cycle, the client employer can also protect their investment in the process by following these steps during the transition period between offer acceptance and start date: 1. Make personal contact with the candidate: As the hiring manager, you can count of your HR department to take care of all the paperwork and assorted material necessary to the new hire process.
